Finale DB Terms of Use

Welcome to Finale DB. These Terms of Use explain what you can and cannot do with our site, data, and services.

All information on Finale DB is provided "as is" for general informational purposes only. It is not safety advice. These Terms include a release of claims and limits on our liability, so please read them carefully.

Quick Summary

Information only, not safety advice: Product details and simulations are as accurate as we can make them, but they are approximations. Always follow the product's label, the manufacturer's instructions, and the law where you are.
Fireworks are dangerous: You use them at your own risk, and you are responsible for how you buy, store, transport, and use them.
We own the database & design: The database and the site's look and feel belong to Finale Fireworks or the respective rights holders.
No scraping or bulk copying: Don't harvest, scrape, or export our database, use it to train AI models, or copy our design.
No bots without permission: Apart from search engines indexing the site, automated tools need our written permission.
You're responsible for what you post: If you upload content, you must have the rights to it.
We're not liable for user content: We don't control what users post and aren't responsible for it.
We can remove or restrict access: We may take action if rules are broken.
Service is provided "as is": No warranties. We're not liable for injuries, damage, or any other consequences of using the information.

Acceptance of Terms

By accessing or using Finale DB (the "Service"), you agree to these Terms of Use ("Terms") with Finale Fireworks ("we," "us," or "our"). If you do not agree, do not use the Service. If you use the Service on behalf of a company or other organization, you agree to these Terms on its behalf and confirm you have the authority to do so.

In these Terms, "Content" means everything on the Service, including data, product information, specifications, performance descriptions, images, videos, simulations, software, code, and the user interface, its designs, and its layouts.

Product Information, Simulations, and Safety

Finale DB is a reference and planning tool. We work hard to keep product information, specifications, demo videos, and simulations accurate, but much of it comes from manufacturers, importers, dealers, and community members, and all of it is provided for general informational purposes only. We do not manufacture, test, inspect, certify, sell, or distribute fireworks, and we do not independently verify information others provide.

Information may be incomplete, out of date, or wrong. Specifications such as size, shot count, duration, colors, and firing pattern are approximate, usually come from others, and may change without notice. A product shown on the Service may not be available, legal, or sold where you live.
Simulations are approximations. Simulations are visual representations generated by software, not measurements or tests of any product. How high, wide, or long an effect looks in a simulation is an estimate. A Verified simulation has been checked by our team against the manufacturer's specifications and demo video, not against the product in your hands, which can vary by batch, age, storage, weather, and how it is set up and fired.
Badges are not guarantees. Verified, and any other badge, label, status, or mark shown on the Service, is not a certification, inspection, or guarantee of any product, its performance, its legality, or its safety.
Not safety, legal, or professional advice. Nothing on the Service is a safety rating or a substitute for the product's label and warnings, the manufacturer's instructions, the laws, codes, and permits that apply where you fire, or the judgment of a trained, licensed professional. Do not rely on the Service to decide safety distances, site layout, audience separation, or whether a product is safe to use. Using the Service does not create a professional or advisory relationship with us.
You are responsible for your fireworks. You are solely responsible for how you buy, store, transport, and use fireworks, and for following the law and the manufacturer's instructions.
Check your own plans. If you use information or simulations from the Service to design or plan a show, including in Finale 3D, you are responsible for checking the plan, the products in it, and the site before anything is fired.

If you find something wrong, please let us know at support@finaledb.com. We may correct it, but we are not obligated to review, correct, or update any Content.

Assumption of Risk and Release

Your use of the Service and your reliance on any Content are at your own risk. Fireworks are inherently dangerous, and buying, storing, transporting, handling, and firing them can cause serious injury, death, and property damage, even when every precaution is taken. You knowingly and voluntarily accept all of these risks.

To the fullest extent permitted by law, you release Finale Fireworks and its affiliates, officers, directors, employees, contractors, agents, and licensors (the "Finale Parties") from all claims and damages of every kind, known or unknown, arising from or related to: (a) any use of or reliance on the Service or any Content, including product information and simulations, and anything done or not done because of it; (b) the purchase, storage, transport, handling, or use of fireworks or any other product, by you or anyone else; and (c) any dispute with a manufacturer, seller, other user, or other third party. This release includes claims based on the negligence of any Finale Party.

Accounts

You can browse much of the Service without an account. If you create one:

You must be at least 13 years old.
Give accurate information, and keep it current.
Keep your password secure. You are responsible for all activity under your account.
Tell us right away if you believe someone has used your account without permission.
Don't create accounts by automated means, or share, sell, or transfer your account.

Ownership of Content

All Content is owned by Finale Fireworks, its licensors, or the respective rights holders, and is protected by intellectual property laws.

You may not remove or alter copyright, trademark, or proprietary notices.
You may not claim ownership of Content that is not yours.

Trademarks

Finale DB, Finale 3D, Finale Fireworks, and their logos are trademarks of Finale Fireworks. You may not use them, or the badges we show on the Service, in a way that suggests we sponsor or endorse you, without our written permission. Other brand names, product names, and logos belong to their owners. Showing a brand or product on the Service does not mean we endorse it, or that its owner endorses us.

Limited License & Permitted Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes. Without our written permission, you may not:

Copy, download, scrape, harvest, or export the Content or the database in whole or in substantial part, except through features the Service provides for that purpose, such as using effects in Finale 3D.
Reproduce, distribute, sell, license, rent, or otherwise exploit the Content or the Service.
Reverse engineer the Service or create derivative works of it, including of its user interface, workflows, and designs.
Get around security measures, rate limits, or access restrictions.

Anti-Scraping, Bots, and Automated Access

Without our written permission, you may not:

Use bots, crawlers, spiders, scrapers, or other automated means to access or copy the Service or Content.
Access the Service systematically or repeatedly to extract data.
Access the Service through anything other than the websites and apps we provide, including by calling our APIs directly.
Use the Content to build, train, test, or improve any database, directory, dataset, competing service, or artificial intelligence or machine learning model.
Frame, mirror, or republish the Service or its Content on another site.

Public search engines may crawl the Service to index it for search results, following our robots.txt file. That permission covers search results only, and we may withdraw it at any time.

Database & Compilation Rights

The selection, coordination, and arrangement of data on Finale DB are protected as a compilation and as a database. Systematic extraction or reuse of any substantial part of the database is prohibited.

User-Generated Content (UGC)

Users may upload, submit, or provide data, images, videos, simulations, text, or other materials ("User-Generated Content" or "UGC").

You keep ownership of your UGC. By submitting it, you grant Finale Fireworks a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, display, modify, and distribute it in connection with the Service, including letting other users view and use UGC you share, such as a Community Effect, as the Service's features allow.
You confirm that you have all the rights needed to submit your UGC, and that it does not infringe anyone's rights or break any law.
We may review, refuse, or remove UGC for any reason, but we have no obligation to.

Disclaimer: Responsibility for UGC

Finale Fireworks does not endorse, control, or guarantee the accuracy or quality of UGC. We are not liable for any loss, damage, claim, or dispute arising from UGC, including infringement, offensive content, inaccuracies, or omissions. Any reliance on UGC is at your own risk.

Feedback

If you send us suggestions, ideas, or corrections, we may use them for any purpose without any obligation to you.

Prohibited Conduct

You may not:

Interfere with or disrupt the Service or its servers.
Access data or accounts you are not authorized to access.
Probe, scan, or test the Service for vulnerabilities without our written permission.
Upload viruses, malware, or other harmful code.
Impersonate any person or company, or claim to represent a brand you do not represent.
Submit information you know is false or misleading.
Harass, threaten, or abuse others.
Use the Service to promote or arrange the illegal sale, transport, or use of fireworks or explosives.
Copy or imitate the Service's look and feel, interface flows, or design for a competing service.
Use the Service in violation of any law or anyone else's rights.

Third-Party Links, Content, and Sellers

The Service links to and embeds content from third parties, such as brand and seller websites and videos hosted on YouTube and Vimeo. We do not control them and are not responsible for their content, products, or practices, and your use of them is governed by their own terms. Finale DB does not sell fireworks. Any purchase you make is between you and the seller.

Other Terms

Some Finale products and services, such as Finale 3D and any paid service, have their own license or agreement. Those terms apply along with these Terms, and control if the two conflict. Our Privacy Policy explains how we handle your personal information.

Enforcement & Termination

We may suspend or end your access and pursue legal remedies for violations, including unauthorized scraping, copying, or replication of our Content, database, or interface. We may also suspend or end any part of the Service at any time, with or without notice. You may stop using the Service at any time. The parts of these Terms that by their nature should continue after your access ends, including ownership, the release, the disclaimers, the limitation of liability, and indemnification, will continue.

Disclaimer of Warranties

The Service and all Content, including all data, product information, specifications, videos, and simulations, are provided "as is" and "as available," without warranties of any kind. To the fullest extent permitted by law, the Finale Parties disclaim all warranties, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not promise that any Content is accurate, complete, current, or reliable; that any simulation matches how any real product looks or performs; that any product is safe, legal, or available where you are; or that the Service will be uninterrupted, secure, or error-free. Nothing you learn from us or through the Service creates a warranty that is not stated in these Terms.

Limitation of Liability

To the fullest extent permitted by law:

The Finale Parties will not be liable for any personal injury, death, property damage, or other loss or harm arising from any use of or reliance on the Service or any Content, or from anything done or not done because of it, including the purchase, storage, transport, handling, or use of fireworks or any other product, and any show designed, produced, or fired with its help.
The Finale Parties will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill.
The Finale Parties' total liability for all claims arising from or related to these Terms or the Service will not exceed the greater of the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or US $100.

These limits apply to every kind of claim, whether in contract, tort (including negligence), strict or product liability, under a statute, or otherwise, even if we were told such damages were possible. They are an essential part of the agreement between you and us, and we could not provide the Service, much of it free of charge, without them.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow certain warranties to be disclaimed, claims to be released, or liability to be limited. Where that is the case, the disclaimers, release, and limits in these Terms apply to the fullest extent the law allows.

Indemnification

You agree to defend, indemnify, and hold harmless the Finale Parties from all claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to your use of the Service, your UGC, your violation of these Terms or of any law or anyone else's rights, or your purchase, storage, transport, handling, or use of fireworks or any other product, including any show you design, produce, or fire. We may take over the defense of any such claim at our own expense, and you will cooperate with us. You may not settle any claim that affects us without our written consent.

Copyright Complaints

If you believe content on the Service infringes your copyright, email support@finaledb.com with:

A description of the copyrighted work.
Where the content appears on the Service.
Your name and contact information.
A statement that you believe in good faith the use is not authorized by the owner, its agent, or the law.
A statement that the information in your notice is accurate, and that you are the owner or are authorized to act for the owner.

We remove infringing content when appropriate and may end the accounts of repeat infringers.

Changes to the Service and Terms

We may change the Service and update these Terms at any time. We will post the current version here with its effective date. If you keep using the Service after an update takes effect, you accept the updated Terms.

General

These Terms, together with any other terms that apply as described above, are the entire agreement between you and us about the Service.
If any part of these Terms is found unenforceable, that part will be enforced to the fullest extent permitted, and the rest stays in full effect.
The Finale Parties are intended beneficiaries of the release, the disclaimers, the limitation of liability, and indemnification in these Terms.
If we don't enforce a part of these Terms, that is not a waiver of our right to enforce it later.
You may not transfer your rights under these Terms without our consent. We may transfer ours.
